Legal Framework for Prashna Kundli
Operating an online spiritual consultancy and product platform like Prashna Kundli requires compliance with several Indian laws. Below is a breakdown of each major law, the sections that apply, and what they mean for your business in practical terms.
1. Consumer Protection Act, 2019
The Consumer Protection Act, 2019 safeguards customer rights in online purchases and services.
Section 2(7): Definition of Consumer
A “consumer” is anyone who buys goods or hires services for a consideration (paid or promised), and not for resale or commercial use.
What this means for you:
Every customer purchasing a gemstone, bracelet, or consultation from Prashna Kundli is legally protected as a “consumer.” You must resolve grievances honestly and provide fair service.
Section 17: Jurisdiction of District Consumer Commission
Any consumer complaint where the value of goods/services is up to ₹50 lakhs can be filed at theDistrict Commission.
Implication:
If a customer feels wronged, they can file a case locally (e.g., in Indore) without a lawyer. You must provide proper documentation and order details if called upon.
Section 49: Product Liability
If a product causes harm due to a defect or misinformation, the seller/manufacturer is liable.
Implication for you:
Ensure all products (e.g., energized yantras, gemstones) are accurately described and safe to use. For energized products, provide clear disclaimers and handling instructions.
Section 94: Preventing Unfair Trade Practices
Misleading advertisements, false guarantees, or selling fake products are punishable.
Actionable Tip:
Avoid exaggerated claims like “100% success” or “guaranteed love back.” Use phrases like “based on astrology,” “results may vary,” or “subject to individual karmic factors.”
2. Information Technology Act, 2000 (IT Act)
The IT Act governs electronic transactions, data protection, and cybersecurity.
Section 43A: Compensation for Failure to Protect Data
If a company fails to implement reasonable security practices and causes loss to a user, they may be liable for damages.
What it means for Prashna Kundli:
Use HTTPS encryption, protect user birth details and payment metadata, and never store sensitive card/UPI data. Your Privacy Policy must clearly explain data usage.
Ensure your site has clear terms of service and user verification during purchases. Never impersonate astrologers or post fake testimonials.
Ensure that customers opt-in for promotional WhatsApp updates and email marketing. Always allow them to opt-out.
Section 66C & 66D: Identity Theft & Online Fraud
Penalizes identity misuse, impersonation, or collecting data fraudulently.
Implication:
Section 72A: Disclosure of Information
Disclosure of personal information without consent is punishable.
3. Indian Contract Act, 1872
All online transactions (product orders or consultations) are legally contracts between Prashna Kundli and the customer.
Section 10: Valid Contracts
For a contract to be valid, it must have:
Free consent
Lawful consideration (i.e., payment)
Lawful object
What this means:
Your Terms & Conditions must:
Clearly mention consultation charges
Include refund/return policies
Explain delivery limitations
This prevents legal voiding of agreements.
Section 23: What Makes a Contract Void
If the object of a contract is illegal or immoral, it’s void.
Implication:
Avoid promoting astrology as a substitute for medical treatment, legal advice, or manipulation. Be ethical in your offerings and write disclaimers like:
“Astrology is a spiritual tool. Results vary and should not replace medical or psychological treatment.”
4. Legal Metrology (Packaged Commodities) Rules, 2011
These rules apply if you sell physical products, such as bracelets, rudraksha, yantras, etc.
Rule 6: Mandatory Declarations
Labels must mention:
Product name
Manufacturer/importer name
Net quantity (e.g., weight, number of beads)
Price (MRP)
Customer care contact
Compliance Tip:
Your product packaging must have all these printed or tagged—even for spiritual goods. If you’re energizing the product, mention the “Date of Energization” too.
5. E-Commerce Rules, 2020
These rules specifically regulate platforms like yours offering goods/services online.
Rule 5: Information to Consumers
You must provide:
Complete company details (name, address, email, phone)
Terms & Conditions
Return/refund/cancellation policies
Product authenticity details
Rule 6: No Unfair Trade Practice
You cannot:
Mislead about benefits
Create fake reviews
Withhold critical information (e.g., energization status, origin of gemstones)
Rule 7: Grievance Redressal Officer
You must appoint a grievance officer and resolve complaints within 1 month.
What to do:
You can designate your customer care number/email as the grievance redressal contact and add:

Phone: +91 91093 01968
6. Protection of Children under COPPA Equivalent
India currently lacks a specific COPPA (Children’s Online Privacy Protection Act), but under IT Act, children’s data protection is implied.

- Our Privacy Policy should clearly say:
“Our services are not intended for users under the age of 13. We do not knowingly collect personal data from minors.”
